Waiver of Liability:

I, the undersigned participant, wish to engage in the fishing and/or sightseeing activities ("Activities") provided by Captain Scott's Adventures (CSA). In consideration of being permitted to participate in the Activities, I agree to the following:

1. Assumption of Risk: I acknowledge that the inherent risks and dangers of the Activities include, but are not limited to, injury, drowning, loss of personal property, and death. I knowingly and freely assume all such risks, both known and unknown, even those arising from the negligence of the releasees or others, and assume full responsibility for my participation in the Activities.
2. Release and Waiver: I hereby release, waive, discharge, and covenant not to sue Captain Scott's Adventures, its officers, agents, servants, or employees (hereinafter referred to as "Releasees") from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, while participating in such Activities, or while in, on or upon the premises where the Activities are being conducted.
3. Indemnification: I further hereby agree to indemnify and hold harmless the Releasees from any loss, liability, damage, or costs, including court costs and attorney fees, that they may incur due to my participation in said Activities, whether caused by negligence of Releasees or otherwise.

Photo Release:

1. Consent to Photograph: I understand that during the Activities, I may be photographed or recorded. I agree to allow my photo, video, or film likeness to be used for any legitimate purpose by Captain Scott's Adventures and their assignees and licensees.
2. Grant of Rights: I hereby grant Captain Scott's Adventures the right to use and publish photographs or videos taken of me during the Activities for advertising, promotional, and marketing purposes, including but not limited to social media, promotional materials, and publications.
3. Waiver of Rights: I waive any right to inspect or approve the finished product or written copy that may be used in connection with an image that Captain Scott's Adventures has taken of me, or the use to which it may be applied.
4. Release of Claims: I hereby release and hold harmless Captain Scott's Adventures from any claims, damages, or liability arising from or related to the use of the photographs or videos as permitted hereunder.
